1. What we do
Pick2Moov (“Pick2Moov,” “we,” “us”) operates a mobile marketplace that connects riders with independent TukTukowners/drivers (“Drivers”) via the Pick2Moov iOS and Android apps (the “Service”). We are not a transportation carrier; Drivers provide transportation services to riders in their own right.
2. Eligibility & Accounts
• You must be 18+ and capable of forming a binding contract.
• An account is required. You agree to provide accurate information and keep your credentials secure.
• We may suspend or terminate accounts for breach, fraud, or safety concerns.
3. The Ride Contract
• When you request and accept a ride, you enter a direct contract with the Driver.
• Pick2Moov provides the platform, routing, and payment facilitation, and may charge a service/platform fee.
4. Pricing, Payments & Taxes
• Fares, fees, and estimates are shown in-app. Final charges may vary due to route/time changes, tolls, waiting time, or applicable fees.
• Payments are processed by Stripe. You authorize charges to your selected payment method for fares, fees, adjustments, and applicable taxes.
• Refunds: No refunds at this time (without prejudice to mandatory consumer rights). Disputed transactions may be handled through Stripe’s chargeback process and our support review.
• Drivers are responsible for their own taxes. Pick2Moov may issue receipts/invoices where required.
5. Cancellations & No-Shows
• You may cancel a ride according to the in-app flow. Cancellation or no-show fees may apply as displayed in-app at the time of cancellation.
• Drivers may cancel for safety or operational reasons (e.g., failure to arrive, unsafe conditions).
6. Driver Requirements
• Drivers must comply with all applicable road, licensing, insurance, and safety laws and maintain their vehicles in safe condition. Pick2Moov may perform limited checks but is not responsible for a Driver’s compliance.
7. Acceptable Use
You agree not to:
• Violate laws, infringe rights, or endanger anyone.
• Harass, discriminate, or engage in abusive conduct.
• Interfere with the Service, scrape, reverse engineer, or bypass controls.
• Use another person’s account or misrepresent your identity.
8. Content & Licenses
• You may submit content (e.g., profile photo, vehicle info, ratings). You retain rights in your content.
• You grant Pick2Moov a worldwide, non-exclusive, royalty-free license to host, display, and use your content to operate and improve the Service.
• Pick2Moov owns the Service, software, and branding. No rights are granted except as expressly stated.
9. Ratings, Reviews & Communications
• Ratings help keep quality high. You agree to provide fair and lawful feedback.
• We may contact you via in-app messages, push notifications, or email for transactional purposes.
10. Availability & Support
• The Service may be unavailable during maintenance or outages.
• Support hours: Business days, 09:00–18:00 (Lisbon time) via in-app help or info@pick2moov.com.
11. Third-Party Services
The Service integrates third parties (e.g., Stripe for payments). Those services are governed by their own terms and privacy notices.
12. Changes to the Service or Terms
We may modify features or these Terms. Material changes will be notified in-app and/or by email with an updated effective date. Continued use after changes means acceptance.
13. Termination
You may delete your account at any time. We may suspend or terminate for breach, safety, or misuse. Upon termination, your right to use the Service ends; certain sections survive (e.g., payment obligations, IP, liability).
14. Warranties & Liability
• The Service is provided “as is” and “as available,” to the extent permitted by law.
• To the maximum extent permitted by law, our aggregate liability arising from or relating to the Service is capped at the greater of €100 or the fees you paid to Pick2Moov in the 12 months before the claim.
• We do not exclude liability that cannot be excluded by law (e.g., death or personal injury caused by our negligence, fraud).
15. Indemnity
You will indemnify and hold Pick2Moov harmless from third-party claims arising from your misuse of the Service or breach of these Terms, to the extent permitted by law.
16. Governing Law & Venue
These Terms are governed by the laws of Portugal, with exclusive jurisdiction in the courts of Lisbon (without prejudice to mandatory consumer venue rights).
17. Miscellaneous
• Severability, no waiver, and assignment rules apply.
• You may not assign your rights without our consent. We may assign to an affiliate or in connection with a merger or asset transfer.
